Terms and Conditions for Photo Uploads

By uploading photos, participants are deemed to have accepted, and have agreed to all of the terms and conditions set out below:

1. The number of uploads for each participant is unlimited.

2. The Hong Kong Jockey Club does not accept responsibility for (a) any loss, damage, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft, destruction, alteration of, or unauthorised access to any photos uploaded; and/or (b) any Fai Chun incorporated with any uploaded photo and/or download or transmission thereof, whether or not arising during operation or transmission as a result of server functions, virus, bugs or other causes outside its control, or any other loss howsoever caused.

3. The Hong Kong Jockey Club will not use or retain any uploaded photos or any other data from which it is practicable for the identity of the individual to be directly or indirectly ascertained; the Club will take practicable measures to ensure that data will not be kept for more than the required period.

4. The digital Fai Chun is designed by The Hong Kong Jockey Club, nevertheless The Hong Kong Jockey Club does not guarantee whether any consent, licence or permission will be required from any third party for a participant’s upload or otherwise display of the Fai Chun incorporated with his/her photo on any platforms.

5. The photo upload function is provided by a third party services provider and each participant agrees that the services provider may use his/her uploaded photos for the purpose of providing, developing and supporting their services enabling the photo upload function.

6. Participants should not post or share any message that is unlawful, harmful, infringing any rights of any third party, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable. If the participant’s message contains the above information, The Hong Kong Jockey Club will not be held responsible for the relevant message.

7. The Hong Kong Jockey Club reserves the right to amend any of the Terms and Conditions at any time without prior notice. The Terms and Conditions are available in both Chinese and English versions. In the event of any inconsistencies between the two versions, the English language version shall prevail.
